Customer shall provide or has provided Kingston a verified gross mass ("VGM") including the weight of the cargo, packing plus dunnage plus the container tare weight. The Customer warrants and represents that the VGM provided by Customer to Kingston is the true and accurate in accordance with the weighing requirements of the International Convention for the Safety of Life at Sea ("SOLAS"), Chapter VI, Part A, Regulation 2. The Customer warrants that Kingston can solely rely on the VGM provided by Customer agrees that Kingston will tender, counter-sign or endorse the VGM provided by Customer as Kingston's own VGM to subcontractors, including the vessel operator. If Customer has any reason to believe the VGM is not accurate, Customer shall notify Kingston immediately. Customer is responsible for any inaccuracies in or absence of the VGM provided to Kingston and will indemnify and hold Kingston harmless such from any and all claims, losses, penalties and/or costs resulting from or in relation to
